2. This Website is a referral and resource service only. The University is merely passing on information provided by NSW Fair Trading, real estate agents, landlords and others and is acting as a facilitator.

3. No representation or warranty is made by the University or its employees, representatives, agents or contractors that the information on this Website is accurate, up-to-date or complete. Neither the University nor its employees, representatives, agents or contractors will be liable to a student, a landlord or any other person for any loss or damage arising directly or indirectly in connection with:

(a) the accommodation listed on this Website;
(b) the use of, or reliance on, the information provided on this Website;
(c) the actions or omissions of the landlords, tenants and other users of this Website;
(d) any arrangement or agreement that is entered into between individuals or other entities as a result of utilising this Website; or.

4. As a condition of listing, landlords are required to confirm whether the property will be let through a residential tenancy agreement within the meaning of the Residential Tenancies Act 2010 (NSW) (“RT Act”). Where a landlord confirms that a residential tenancy agreement will be used, the University relies on that representation to form the view that the listed accommodation falls within an exclusion from the definition of “Student Accommodation” in the National Higher Education Code to Prevent and Respond to Gender-based Violence 2025 (the “Code”) and, accordingly, that the landlord is not an “Affiliated Student Accommodation Provider” for the purposes of the Code.

5. The University does not independently verify whether a residential tenancy agreement is in fact entered into between a landlord and a tenant, nor does the University verify the terms or enforceability of any such agreement. No representation or warranty is made by the University or its employees, representatives, agents or contractors that makes as to:

(a) the compliance of any landlord or tenant with the RT Act;

(b) the nature or enforceability of any agreement entered into between a landlord and a tenant;

(c) the applicability or non-applicability of the Code to any particular property or landlord; or

(d) whether any particular property falls within an exclusion from the definition of “Student Accommodation” under the Code.
